ATTENTION:  No matter how careful we are, or what kind of safety precautions we take; horses can be dangerous.  We take all safety precautions to maintain the highest level of safety but horses can be unpredictable at times.  ALL persons MUST have a signed release of liability to be on this property even if you are just a guest.  Please read this release and submit this form below.  This form is an e-contract and is legally binding.

RELEASE:

This Release serves as a release of liability for WHISPERING MEADOWS RANCH (“Ranch”).

YOU understand and agree to uphold the terms and conditions of this Release.  In addition, YOU agree to hold harmless and indemnify the Ranch for any action, in law or equity, that is filed based on any act or failure to act as it relates to the activities of the Ranch for which YOU participated, or which occurred while YOU were on Ranch property.  This Release supersedes all prior Releases, written or verbal.

YOU understand that horses, as wild animals, even horses that have been highly trained, are unpredictable and pose unreasonable dangers to human beings, including the possibility of death.  Horses can rear, buck, gallop, frighten, spook, kick, bite, trample, and crush human beings without warning.  As such, the mere fact of being around horses exposes you to each and every one of these possible dangers, including any other unpredictable acts of a wild animal.  And, riding a horse, even when led by a trained and experienced guide, exposes YOU to each of the dangers listed above, as well as any other unpredictable act of a wild animal.  As such, YOUR presence around any horse, including, petting, feeding, walking by or near, mounting, dismounting, riding, or any other act on, near, around or by a horse places YOU directly in danger of the harms discussed herein.

YOU understand and accept all responsibility for your actions and all harms or injuries caused by or arising out of the unpredictable results of any horse to or as a result of YOUR acts or actions, or the acts or actions of or reactions from any other horse proximately caused by a horse that YOU are on, near or around.  YOU also understand and hold the Ranch harmless for any other acts or actions occasioned by another Boarder or Visitor that causes any actions of or reactions from a horse that causes you any damage, harm or injury.  YOU agree to accept complete responsibility for any harm, damages or injuries caused by any Visitor YOU brought to the Ranch, or that occurred to them.  In addition YOU agree to accept total financial responsibility for all harm, damages or injuries caused by YOU, or a Visitor YOU brought to the Ranch, including their equipment, or animals. 

YOU agree that any and all Visitors you bring onto the Ranch shall sign this Release.  If he or she refuses, that person shall immediately leave the Ranch, and YOU shall cause that person to promptly leave Ranch property, or, YOU shall immediately contact law enforcement and, under authority of law, have that person removed as a trespasser.  No person shall be allowed at the Ranch unless that person is bound by this Release.

YOU completely understand and accept the dangers associated with the Ranch and the risk of serious injury or death that could result from being by, near, on or around horses, with or without the acts or actions of any other person.  Under no circumstances will YOU attempt to pursue any form of legal action, either legal or equitable, against the Ranch, or any other Boarder or Visitor resulting in harm, damage, or injury to YOU or YOUR Visitor, except where you can prove by clear and convincing evidence that the Ranch or any Boarder or Visitor acted with reckless disregard of your safety.

I agree to and accept to uphold the terms of this Release.  By checking “I Accept” and clicking the “I Accept ” button to submit this contract, I understand and accept that I am assuming complete responsibility for any harm, damage or injury resulting from my presence at the Ranch.  I understand that this is an e-contract or web contract and agree that by submitting this form the “I Accept” field serves as my authorization, acceptance and signature and will be considered as a signed contract in a court of law.
